We reserve the right to terminate your access to our website and services at any time and without notice if you violate these Terms & Conditions.

These Terms & Conditions are overseen by and taken in accordance with the laws of the State of Florida, United States, and you agree to submit to the exclusive power of the courts in that jurisdiction.

10 Updates to Terms

We may update these Terms & Conditions at any time. It is your responsibility to review these Terms & Conditions periodically for changes. Your continued use of our website and services after any modifications constitutes your acknowledgment and consent to be bound by them.

11 Policy on Revisions

Based on the package you selected, we provide revisions on your project. Customers can request modifications, and we will revise their design at no extra cost as long as the design and philosophy remain the same.

12 Project Completion

TripTych Digital will formally send the customer a project completion email once the website goes live. Once the project completion email is sent out, the customer will have 48 hours to check the website and let us know if there are any additional changes required or any issues we can fix for you.

After 48 hours are complete, our system automatically takes everything from our developers and discards any usable files to ensure that you remain the sole owner of the site.

13 Money-Back Guarantee / Refund Policy

In any case, funds deposited for a project are not refundable after the original design proposals are approved or a modification is demanded, unless TripTych Digital cancels or terminates the Contract for a reason other than your violation or non-performance. No refund is applicable after the project is completed.

Refund requests must be fulfilled as follows:

• You may request a refund when the initial design concepts are offered. However, once you approve or request changes to the initial designs, the refund offer becomes void.
• If your refund request is made before the delivery of initial design concepts, you are eligible for a refund (less 10% service & processing fee).
• If refund request is made within 48 hours of signing up, you are eligible for a 66% refund (less 10% service & processing fee).
• If refund request is made between 48–120 hours of the initial design delivery, you are eligible for a 33% refund (less 10% service & processing fee).
• No refund request will be entertained after 120 hours of your initial design delivery. However, since we believe in 100% customer satisfaction, you are encouraged to contact us in case of any concern.
• No refund request will be entertained if you have not taken any action on your order for 30 days after placing your order. However, if you want to reactivate your design order, you will be charged a certain fee depending on your project.
• No refund requests will be entertained after the final files have been delivered.
• For website packages, no refund will be entertained once website development has been completed or once the website has been deployed live.
• For video animation packages, no refund request will be entertained after the designing of the storyboard.
• All refund requests should be communicated to the support department. TripTych Digital, based on the violation of your user agreement, reserves the right to approve/disapprove your request on a case-by-case basis.
• For custom packages, refund will be applicable the same as it is on single packages. For example, if you order logo and web design service and approve the logo, you can claim refund for the website service at the time of initial design only.
• A refund request will need to have a valid reason which must be qualified against the design brief and customer feedback for revisions. Unless a concept has not been designed according to the brief, a refund will not be given; however, further revisions will be provided until complete satisfaction.
• Money-back guarantee is based on the order being placed in good faith. Where a customer has placed design orders with more than one design agency for the same job with the intention to claim refund, we do not consider it good faith. In such a case, we reserve the right to decline a refund request.
• All design jobs require customer feedback before finalizing the design; therefore, it is only fair that the customer gets involved and provides feedback in order to get the desired results.
• 100% unique design guarantee entitles you to a re-draw if our designed logo is found considerably similar to another logo design that may already exist. Any resemblance to an existing design will be merely a coincidence and TripTych Digital will not accept any responsibility or claim of any compensation in such a case. It is the client's responsibility to get their artwork copyrighted.
• If an individual, entity, or company gets into permanent or temporary closure or hold of business activity, the amount paid or received for SEO and social media is not refundable.
• Website design and development require extensive resources and consume our time and internal expenses. Thus, once payment is deposited, it becomes non-refundable no matter how long the project was.
• SEO and social media marketing payments are non-refundable, and there are no exceptions to our refund policy or money-back guarantees.
• No refund request will be entertained for Hosting, SSL, TLS, SEO, Content Writing, and Social Media Services.
• Patent and trademark fees that have been paid generally cannot be refunded, and the payment method that was used cannot be changed afterwards. In very limited situations, a refund of fees paid may be allowed if the filing has not been completed.
• Once the mockups OR the website is placed on a test link and is approved, there is no refund.
• There are no refunds for any legal paperwork services provided.
• There is no refund for website maintenance packages.

14 How to Request a Refund

We will try to resolve your concern by virtue of our revision policy immediately, or else will email you a refund request approval from our refund department. After the refund, your design rights would be obtained by TripTych Digital and you would not be able to display any version of the design sent by the company.

Since the design rights would then be transferred to the company, you agree that you will have no right (direct or indirect) to use any response or other content, work product, or media, nor will you have any ownership interest in or to the same.

Working in collaboration with government copyright agencies, TripTych Digital would share Copyright Acquisition information for the refunded designs that would restrict the re-use of the designs as original designs in the future. 15 Quality Assurance Policy

In order to provide you with the desired satisfaction, our designers do not deviate from the specifications provided by you in the order brief form. The designs are created after thorough research, which ensures the design quality and uniqueness.

16 100% Satisfaction Guarantee

We rework the ordered design and keep revising it until you are 100% satisfied (depending upon your package).

17 Effective Communication Policy

Our organization is committed to delivering the highest level of service and satisfaction to our valued clients. In this regard, we emphasize effective communication and collaboration throughout the project lifecycle.

Client Engagement & Feedback

We encourage open dialogue and iterative feedback during project execution. Clients are invited to provide their comments and revisions within a reasonable timeframe to ensure the project aligns with their vision and requirements.

Escalation Protocol

In instances where we do not receive a response from the client within a two-week period, our established escalation protocol will be initiated to ensure clarity and progression:

• Initial Intimation Email: A formal email will be shared, detailing the status of the project and the necessity for client input. Upon receipt, the client is allotted an additional two weeks to provide feedback.
• Subsequent Communication: In the event of non-response after the first intimation email, a follow-up communication will be dispatched. An additional two-week window will be granted for the client's response.
• Final Notification: Should the project remain inactive even after the second communication, a final intimation email will be dispatched — serving as a final opportunity for the client to contribute.
• Project Closure & Reinstatement: Failure to respond within 48 hours of the third intimation email will result in the project's formal closure. However, clients retain the option to reopen the project by remitting a "Project Reopening Fee." This fee contributes to the effort required for the reinstatement process.

18 Domain and Hosting

Complimentary domain and hosting services will be extended to you as part of your package, provided they are included in the package. In the event that these services are not included in the package, an additional fee will be levied based on the domain and hosting package of your selection.

19 Access to Information

To access TripTych Digital services, you may be asked to provide certain registration details or other information. By accepting these Terms & Conditions, you acknowledge that all information provided by you will be correct, current, and complete.

If TripTych Digital believes the information you have provided is not correct, current, or complete, TripTych Digital has the right to refuse your access to any services or any of its resources, and to terminate or suspend your account at any time.

TripTych Digital is operating under a PCI DSS compliant company; therefore, it is authorized to keep your credit card information on file, which can be used for any recurring service, additional development hours, server or network equipment required to develop or launch your website without any prior notification. However, our representatives always keep you informed so that you are aware of all the processes.

20 100% Unique Design Guarantee

Each of our website and logo designs is meticulously crafted from the ground up, guaranteeing absolute originality, with no reliance on templates or pre-existing content.

21 Prohibitions

The Company will assist the Client with the integration of third-party plugins and APIs, but any third-party integration required to assist with the functionality of the website will be strictly standard. The company will not have anything to do with any third-party dealings during the development of this project. All additional work will require a separate fee agreement.

TripTych Digital will not be responsible for any updates or changes to plugins or third-party integrations after completion of the project, unless maintenance services have been acquired for the same.

The terms and conditions outlined in this agreement are subject to change at any time without prior notice. Any modifications or revisions to the terms and conditions will be effective immediately. It is the responsibility of the user to review the terms and conditions periodically. By continuing to use TripTych Digital's services after any changes have been made, the user agrees to be bound by the updated terms and conditions. If the user does not agree with the modifications, they should discontinue the use of TripTych Digital's services. (Please note that a refund will not be applicable if the reason for discontinuing the services is a change to the terms and conditions.)
